We are currently looking for two Contract Managers for our Mobility and Transversal Integrated Solutions (TIS) Divisions. Both positions are based respectively in Aartselaar and Braine-l’Alleud.

What we expect from you as a Contract Manager within our operational divisions:

• you ensure the follow-up of contractual obligations for several projects alongside the Project Manager
• you act as the liaison between the Contract Management of the Division and the Contract Management department of Equans Belux
• in this role, you are involved in the various phases of specific projects that we undertake
• you report to the Division Managers Mobility & TIS with a functional link to the Direction of Contract Management of Equans Belux

And in concrete terms?

• you assist the bidding team in preparing internal files for the analysis of contractual risks, planning, technical, and financial aspects that will be presented to the General Management
• you monitor the contractual requirements of projects, accompany teams in the interpretation of contractual terms, and the development of strategy
• you support project managers in managing customer contracts, consortia, subcontracting, and supply
• you contribute to the implementation of processes and tools necessary for contract execution monitoring
• you draft and monitor correspondence and project notifications/events, and contribute to achieving the economic objectives of projects
• in collaboration with the project team, you supervise the evaluation and management of contractual risks and anticipate opportunities to maximize their realization
• you support the project leader in negotiations with various stakeholders regarding contractual issues
• you handle pre-dispute situations with the support of the legal department, compile claims files, and provide the project team with advice on the strategy to follow
• you develop internal training on various recurring contractual topics that you identify and present to project teams
• you work closely with various internal departments (Insurance, Legal, Project & Risk Performance, Finance, Purchase)
• you contribute to maintaining a good relationship with the client, partners, and subcontractors
• you exchange ideas with your colleagues, contract managers, in the Belux and Europe division and participate with them in its coordination

Regular travel to project sites is expected to gain a concrete and clear understanding of the circumstances.

What do you need?

• with a background in engineering or law, you have a solid experience of at least 5 years in a similar role and/or through experience as a controller or project manager with a focus on contract management, in projects in the tertiary, industrial, or infrastructure sectors
• you have practical knowledge of various MS Office applications
• you are familiar with collaborations in complex structures
• you have excellent professional knowledge of French and a good understanding of Dutch and English

Mobility and Transversal Integrated Solutions (TIS) Divisions:

The Mobility Division specializes in the design, implementation, and maintenance of electromechanical infrastructure projects of various sizes in Belgium, in a mobility context. Juridisch Contractmanager

Equans streeft voortdurend naar de beste service voor haar klanten en combineert daarbij vakmanschap, de modernste technieken, veiligheid, duurzaamheid en rendement. Actief op een scala van vakgebieden, en gericht op grote en complexe utilitaire en industriële projecten, services en onderhoud. Er wordt gewerkt vanuit diverse vestigingen en projectlocaties. Voor regio West Industrie zijn wij op zoek naar een Contractjurist. Je rapporteert aan de General Counsel van Equans Nederland en functioneel aan de Commercieel Directeur van West Industrie en maak je landelijk onderdeel uit van een groot team bedrijfsjuristen en contractmanagers.

Contract jurist, Equans West Industrie

Als Contract jurist waarborg je de contractuele belangen bij industriële projecten in zowel de aanbiedings- als realisatiefase. Hiernaast ben je betrokken bij projectuitvoering bij het opstellen van omvangrijke, of van de normale procedure afwijkende, meerwerk opgave. Je onderneemt acties ter voorkoming van claims, vorderingen of aanspraken. Als Contract jurist  bevorder je contract awareness binnen het eigen bedrijf en implementeer je best practices in samenwerking met collega’s van andere vestigingen. Ben jij de persoon die deze verantwoording kan dragen? Vind jij het leuk om zelfstandig te werken en toch onderdeel te kunnen zijn van een grote groep?

Dit ga je doen als contract jurist

In de tenderfase signaleer je kansen en mogelijkheden welke contracten bieden en analyseer en beoordeel je af te sluiten geïntegreerde contracten op potentiële juridische en commerciële risico’s en adviseert hierover. Je ondersteunt de accountmanager, tendermanager & projectdirectie tijdens onderhandelingen met opdrachtgevers en adviseert deze over contractuele condities, het voorkomen en beperken van risico’s en aansprakelijkheid en de gewenste vorm en inhoud van de af te sluiten contracten.

Daarnaast ondersteun je de projectteams in de realisatiefase op juridisch en commercieel gebied. Je beheert afgesloten contracten, fungeert als geweten van de projectmanager en bent tijdens de uitvoering vraagbaak voor interne afdelingen. Naast de tender- en projectdirectie/projectmanager werk je hecht samen met uitvoeringsteams, de inkoopafdeling en Bedrijfsjuristen van de afdeling Juridische Zaken. In deze functie is je standplaats Rotterdam maar ben je ook veelvuldig in gesprek op klant locaties in de regio groot Rotterdam.

Dit breng je mee

Je hebt minimaal 10 jaar relevante juridische ervaring (o.a bouwrecht praktijk) en/of binnen een projectenorganisatie. De dynamiek van een projectenorganisatie spreekt je aan en je werkt graag met techneuten. Je hebt affiniteit met de industrie, hebt hierin ervaring en spreekt de taal. Je ziet uitdaging in het ondersteunen van een projectteam, je creëert kansen en je bent commercieel gedreven. Als persoon ben je analytisch sterk, daadkrachtig en een systeemdenker. Het delen van kennis en ervaring binnen je team en de organisatie is voor jou vanzelfsprekend.

Verder ben je in het bezit van:

• Een afgeronde studie Nederlands recht
• Minimaal 10 jaar ervaring in het (industriële) bedrijfsleven dan wel advocatuur (bouwrechtpraktBrede technische affiniteit
• Uitstekende Nederlandse en Engelse taalvaardigheden en sterke commerciële vaardigheden
• Goede communicatieve skills en deins je niet terug voor onderhandelingen
• Ervaring met FIDIC en UAVgc contracten is een pré.

Poste

Dans le cadre de son développement, ERAS Ingénierie recrute pour son agence de Lyon (69), son/sa futur(e) Contract Manager. Rattaché(e) au Directeur Projets et Performance, vos principales missions et responsabilités seront les suivantes :

• Vous intervenez sur les sujets commerciaux et contractuels en exécution de projet. Dans ce contexte, vous accompagnez le chef de projet dans l'instruction des avenants et des réclamations et établissez dans un esprit collaboratif, des procédures contractuelles spécifiques en lien avec les fonctions connexes (achats, juridique, finance, assurance, fiscalité)
• Garant·e du respect des engagements conclus avec le client et les partenaires, vous participez à la rentabilité des projets grâce à votre approche pragmatique et proactive.
• Fort·e de vos excellentes capacités d'analyses techniques et commerciales, de votre savoir-faire contractuel et juridique, vous suivez l’application du contrat tout au long du projet, mettez en œuvre et coordonnez les moyens et processus nécessaires à la maîtrise des risques financiers et juridiques encourus.
• En complément de votre activité sur projets, votre expérience et votre expertise en contract management vous amènent à participer en phase offre à la rédaction et à la négociation des contrats. Vous intervenez également en tant que conseil aux équipes projets et achats sur des problématiques contractuelles (gestion des contentieux etc…)
• Vous participez également à la mise en place et au déploiement des processus et des outils de contract management
• Vous assurez des formations en contract management aux collaborateurs afin d'accroitre la maitrise des risques et la performance de la gestion des projets

Profil

Titulaire d'une formation de type Ingénieur/Gestion/Droit des Affaires, vous disposez d'une expérience démontrée et approfondie en tant que Contract Manager dans le domaine des achats industriels dans le cadre de grands projets dans un contexte multiculturel.

Votre capacité à influencer, à travailler en équipe, à fédérer et votre envie de transmettre votre savoir contractuel, sont de réels atouts pour le développement des compétences des équipes en management des contrats.

Votre anglais est courant.

Legal Counsel

For the Legal team in Brussels we are looking for a Senior Legal Counsel.

Your main responsibilities are:

• monitoring complex contracts and transactions
• negotiating and drafting all kinds of commercial contracts (building contracts, joint venture agreements, maintenance agreements, shareholder agreements, etc.)
• providing practical legal advice on a wide variety of legal issues relating to all Equans activities (contracting law, contract law, public procurement law, PPP, company law,...)
• monitoring national and international disputes involving Equans
• analyzing (public and private) tender documents (in particular during the tender phase) and providing practical advice (also in the implementation phase)

Do you possess the following competencies & talents? Then you are the colleague we are looking for!

• you have a master's degree in law
• you have at least 5 years' experience in the sector (including 3 years at the bar), preferably as a lawyer or in-house lawyer in an international environment
• demonstrable experience in commercial law and/or public law and more general contract law is a must
• experience in company law and financial law is appreciated, but not required
• you have a talent for and interest in negotiating complex contracts and transactions
• you have an interest in and understanding of the non-legal aspects of a project: technical, commercial, financial and strategic aspects
• you have strong communication and interpersonal skills
• you are proactive, positive, pragmatic and have an open mind
• you are assertive, self-confident and a real team player, while at the same time being able to work autonomously
• you speak and write French and English fluently and you can at least also express yourself verbally in Dutch
